Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Lockabea website, products, software, and services (collectively, the “Services”). By purchasing, accessing, or using Lockabea, you agree to these Terms.
If you do not agree, you must not use the Services.
1. Overview of Services
Lockabea provides a wearable personal security device with connectivity features including, where available:
- GPS-based location services
- Cellular communication features
- Emergency alert functions
- User account and referral system functionality
- Subscription-based connectivity services (if applicable)
Lockabea is a consumer electronic product and is not a medical device, emergency response service, or guaranteed safety system.
2. Eligibility
To use Lockabea, you must:
- Be at least the age of majority in your jurisdiction, or have parental/guardian consent if a minor
- Provide accurate account and payment information
- Agree to comply with all applicable laws
If a minor uses the device, the parent or guardian is responsible for supervision and compliance with these Terms.
3. Safety Acknowledgment
By using Lockabea, you acknowledge that you have read and agree to the Lockabea Product Safety & Intended Use Policy, which outlines foreseeable risks associated with wearable use, including lockable band functionality, environmental hazards, and connectivity limitations.
You understand that improper use may result in injury, discomfort, or device entrapment risk if misused.
4. Purchases & Orders
4.1 Product Availability
Products may be offered on a pre-order or limited availability basis. We do not guarantee immediate shipment unless explicitly stated.
4.2 Pricing
Prices are subject to change at any time prior to purchase confirmation. Applicable taxes and shipping fees may be added at checkout.
4.3 Order Acceptance
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or pricing errors.
5. Pre-Orders
If you purchase a pre-order item:
- Estimated delivery dates are projections only and may change
- Manufacturing delays may occur due to supply chain, regulatory, or production factors
- You may cancel your pre-order before shipment unless otherwise stated at checkout
- Refund processing times may vary depending on payment provider
6. Subscription Services (If Applicable)
Some features of Lockabea may require a paid subscription, including cellular connectivity.
By subscribing, you agree that:
- Billing occurs on a recurring basis (monthly or annual, as selected)
- Subscriptions automatically renew unless cancelled
- Failure to pay may result in service suspension or limitation
- Carrier or third-party service availability may impact functionality
7. Cellular & Connectivity Limitations
Lockabea relies on third-party networks and services. We do not guarantee uninterrupted service.
Service may be affected by:
- Network coverage limitations
- Device battery level
- Environmental conditions
- Carrier outages or third-party failures
Emergency or location features may not function in all situations.
8. Returns & Refunds
Returns and refunds are governed by our Return Policy. Eligibility may vary based on product condition, usage, and purchase type (including pre-orders and subscriptions).
9. Warranty Disclaimer
Lockabea provides a limited warranty as described in the Warranty Policy.
Except as expressly stated, the Services and products are provided “as is” and “as available,” without additional warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by law.
10. Acceptable Use
You agree not to:
- Misuse or tamper with the device or software
- Attempt to reverse engineer or extract source code
- Use the Services for unlawful purposes
- Interfere with network operations or security systems
- Use the device in a way that creates unreasonable risk of harm
11. Intellectual Property
All content, branding, software, designs, and materials related to Lockabea are owned by or licensed to Lockabea and are protected by applicable intellectual property laws.
You may not copy, reproduce, or distribute any part of the Services without written permission.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
Lockabea, its directors, employees, affiliates, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury resulting from misuse of the product
- Loss of data, connectivity, or service interruptions
- Delays or failures in emergency communications
- Property damage arising from improper use
Nothing in these Terms limits liability that cannot legally be excluded under applicable consumer protection laws.
13. Assumption of Risk
You acknowledge and agree that:
- You understand the intended use and limitations of Lockabea
- You assume responsibility for safe use of the device
- No wearable or connected device can eliminate all risks or guarantee safety outcomes
14. Indemnification
You agree to indemnify and hold harmless Lockabea from any claims, damages, liabilities, or expenses arising from:
- Your misuse of the product
- Your violation of these Terms
- Your violation of any applicable laws
15. Privacy
Your use of Lockabea is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
16. Termination
We may suspend or terminate access to Services if:
- You violate these Terms
- Fraud or abuse is suspected
- Required by law or regulatory authorities
17. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, and applicable federal laws of Canada.
Any disputes will be resolved in the courts of Ontario, unless otherwise required by law.
18. Changes to Terms
We may update these Terms from time to time. Continued use of Lockabea after changes means you accept the updated Terms.
